Notice of Development Charges By-Law Passage
Take notice that the Council of the Town of Innisfil passed Development Charge By-laws No. 096-23, 097-23, 098-23, 100-23 and 101-23 on the 8th day of November, 2023, under Section 2 of the Development Charges Act, 1997 (the Act).
And take notice that any person or organization may appeal to the Ontario Land Tribunal under Section 14 of the Act, in respect of the Development Charges By-law, by filing with the Clerk of the Town of Innisfil on or before Tuesday, December 19th 2023 a notice of appeal setting out the objection to the By-law and the reasons supporting the objection. Appeals filed with the Office of the Clerk at 2101 Innisfil Beach Road, Innisfil ON L9S 1A1, will be accepted on or before Tuesday, December 19th, 2023. A processing fee will be payable to the Town of Innisfil Clerk’s Office with the appeal application. The appellant is advised to contact the Ontario Land Tribunal (formerly the Local Planning Appeal Tribunal and Ontario Municipal Board) to access required forms and applicable fees.
The charges in the aforementioned by-laws will apply to all new residential, industrial and non-industrial development, subject to certain terms, conditions and limited exemptions as identified therein.
The development charges were calculated on a Town-wide and area-specific basis. Town-wide development charges are levied against new development to pay for the increased capital costs related to the provision of such municipal services as: Library Board, Fire Services, Police Services, Parks and Recreation, Services Related to a Highway: Public Works, Municipal Fleet, By-law Services and Services Related to a Highway: Roads and Related.
Development charges imposed for Innisfil North, Friday Harbour Resort, Innisfil South, Innisfil Central and Cookstown Servicing Areas include Water Distribution, Wastewater Collection, Water Supply and Treatment Service (Plant) and Wastewater Treatment (Plant). Map 1 delineates all applicable areas within the Town in which the area-specific charges are applied.
Schedule 1 provides the new residential and non-residential development charge rates applicable throughout the Town of Innisfil. It is important to note that the DC rates will be phased-in in accordance with the requirements of the Act (see Schedule 2).
The development charges imposed under the By-laws will come into effect on the 1st day of January, 2024. Copies of the complete Development Charges By-laws are available for examination by appointment in the offices of the municipality located at 2101 Innisfil Beach Road, Innisfil ON, and on the website at www.innisfil.ca.
