Our Place – Status

The Town of Innisfil’s Official Plan, Our Place, sets out goals, objectives and policies for managing growth and development. 

Background

On January 17, 2018, by By-Law No. 007-18, Council for the Town of Innisfil adopted Our Place, the Town’s new Official Plan. On October 9, 2019, Council for the County of Simcoe approved Our Place, after it was approved by the County’s Committee of the Whole on September 25, 2019. In its Notice of Decision, the County placed the following three non-decisions on Our Place:

  1. Section 23.1.16 of Our Place;
  2. On those lands not designated Agricultural on Schedule B, that are, however, identified as part of the provincial Agricultural System on Schedule BB; and
  3. Certain lands surrounding the Settlement Area of Churchill, as identified on Schedule 5 to Item CCW-2018-482.

On November 13, 2018, Our Place came into effect, with the exception of those lands and/or policies that were appealed. 

Appeals

The Town received the following 7 appeals of Our Place:

Those appeals were forwarded to the Local Planning and Appeal Tribunal (“LPAT”) and assigned case number PL180900. A Case Management Conference was held on August 13, 2019, before Vice-Chair Schiller and Member Bryson. A copy of the decision from the Case Management Conference can be found here. All matters were ordered to proceed to a written hearing under Bill 139 in May 2020, however, as a result of COVID-19, LPAT has adjourned these hearings indefinitely.

On January 10, 2019, the County issued a Notice of Limiting Appeal Period. Pursuant to that Notice, the Town received six appeals of the County’s Non-Decisions. Those appeals are:

These appeals were not forwarded to the LPAT by the County. The County has since made a decision on the Non-Decision over Section 23.1.16 and acknowledged that the Non-Decisions over Schedule B and the Churchill Lands were not valid.
